- Information that we reasonably believe to have been lawfully made available to the general public either by you or from widely distributed media.
- Information which was made available to us by a person other than you, if we have a reasonable basis to believe that you provided the information to the disclosing party without restricting further disclosure of such information to a specific audience.
- Information otherwise excluded from the scope of California’s Privacy Legislation.
We receive and store certain Personal Information when you submit an online form to us via the Websites, use other Foundation Source services and resources provided via the Websites, or communicate with us by email or telephone. This information may include, among other things, your name, address, telephone number, and email address. You also have the option of registering with the Websites in order to get access to our proprietary content, and should you opt to register we will collect certain Personal Information. Additionally, if you purchase products or services from our Websites, we will also collect your payment and billing information, and will maintain a record of your purchases, transactional information, and (where applicable) communications and responses associated with the purchasing account. Note, however, that we will not store or collect your payment card details in connection with such transactions. That information is provided directly to our third-party payment processors, which will process and secure your Personal Information in accordance with their privacy policies. In all cases, the Personal Information that we collect is used only for our internal purposes and those of our affiliates and is not shared with unaffiliated third parties, other than our vendors who are providing services to us.
You acknowledge and agree that you, not Foundation Source, are solely responsible for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all Personal Information that you submit, and for ensuring that any Personal Information that you provide is kept up to date for the purposes for which you provide it. Inaccurate information may affect your ability to use the Websites, the information you receive when using the Websites, and our ability to contact you.
Information that you submit on behalf of third parties:
From time to time, you may choose to refer others to our services. When you refer others to our services, we will ask that you provide the name, e-mail address, professional title, and related Personal Information stated in the referral form to enable us to contact them for marketing purposes. You are responsible for ensuring that you have all consents and authorizations required to enable us to process the Personal Information that you submit. For example, in the case of a referral, you should ensure that the referred person has agreed that you may provide their Personal Information.
Information Gathered Automatically:
When you visit our Websites, we may collect and store the domain name from which you accessed our Websites, the IP address of your computer (an IP address is the unique number that identifies a computer on the Internet), the type of Internet browser you are using, the date and time of access, the pages you visit during your stay, the forms you submit on the Websites, and the search terms you used to find the Websites. We may also collect and store information regarding whether you have received, opened or forwarded emails received by you from Foundation Source. This information is used only for our internal purposes and those of our affiliates and is not shared with unaffiliated third parties, other than our vendors who are providing services to us.

Retention of Personal Information
We review our data collection practices to ensure that our collection, use, retention, and sharing of Personal Information is reasonably necessary, proportionate, and consistent with what an average consumer would expect at the time of collection. We determine the retention periods applicable to any consumer Personal Information collected through the Websites according to the purpose(s) for which the information was collected. Once the purposes for which the Personal Information was collected are no longer applicable, we will anonymize and/or destroy the relevant Personal Information.
Aggregate Information:
Foundation Source may share aggregated, anonymous statistical information about visitors to Foundation Source with our affiliates, partners, and contractors providing services to us. We use such aggregated data to maintain and operate our websites, to improve the quality of our services, to create new services and features, and for further internal, commercial and statistical purposes. We do not treat aggregated information as “Personal Information” if it does not identify you and is not directly linked to your Personal Information.
Disclosure of User Information:

Please be aware that we provide links to Linked Websites as a service to our visitors, and that we are not responsible for the content, privacy policies or information collection practices of any other web site. Please note that the privacy policies and other policies of the Linked Websites may differ from those of Foundation Source. Should you decide to access such Linked Websites, you do so at your own risk. We encourage you to review and understand their privacy practices and all terms and conditions of agreement before providing them with any information. Foundation Source is not responsible for any such provisions, and expressly disclaims any and all liability related to such provisions and the Linked Websites.
Children:
Foundation Source is a commercial business web site and is neither designed nor intended to collect Personal Information from children under the age of sixteen. If a child under the age of 16 submits information to us through any part of the Websites and Foundation Source becomes aware that the user submitting the information is under the age of 16, the information provided will be deleted promptly after it is discovered and not used for any purpose. Text Messaging:
When you opt-in to receive text messages from us through a web form, verbally, or other medium, we use Personal Information collected from you, such as your telephone number and communication preferences, solely for the purpose of sending you requested text messages. We do not sell, rent, or share Personal Information from your consent to receive text messages with third parties for their direct marketing purposes. The information is only used by us for the purposes set out in this Privacy Notice and by our SMS service provider to send requested text messages. You may opt-out of receiving text messages from us at any time by either replying “STOP” to any text message, or contacting us at or 1-800-839-0054. While message frequency varies, we will not send more than five messages per week unless otherwise requested by you. Standard message and data rates may apply. You are responsible for any charges from your mobile carrier, and any delays or errors in SMS delivery caused by a mobile carrier or third-party service provider.
Security:
We employ commercially reasonable technical safeguards to store and maintain Personal Information to protect it from loss, misuse, alteration, or destruction by any unauthorized party. Additionally, we maintain a framework of policies and processes to address the integrity, confidentiality and security of our data as appropriate. Please be aware, however, “perfect security” does not exist on the Internet or in any method of storage. To help protect the confidentiality of your Personal Information, you must keep the Personal Information associated with your use of the Websites confidential and not disclose it to any other person. Note that Foundation Source may have additional security obligations in cases where we process Personal Information in connection with a customer’s subscription to our products and services. No Liability for Acts of Third Parties:
Foundation Source will use reasonable efforts to safeguard the confidentiality of Personal Information. Foundation Source has no liability for disclosure of Personal Information due to errors in transmission or unauthorized acts of third parties including interception of email sent/transmitted to Foundation Source by a client via the internet.
USE OF THE WEBSITE FROM OUTSIDE THE UNITED STATES:
We do not represent or warrant that the Websites, or any part thereof, are appropriate or available for use in any particular geographic location outside of the United States. If you choose to access our Websites, you do so on your own initiative and at your own risk, and are responsible for complying with all local laws, rules, and regulations applicable in your jurisdiction. Please note that the Websites are hosted in the United States and is governed by United States law. If you are visiting the Websites from outside the United States, please be aware that your information will be transferred to, stored and processed in the United States where our servers are located and our central database is operated. HOW TO DISCONTINUE MARKETING COMMUNICATIONS WITH FOUNDATION SOURCE:

You may opt out of receiving unsolicited emails from us by clicking on the link in the email footer to manage your preferences. CHANGES TO THIS PRIVACY NOTICE; ADDITIONAL TERMS:
You understand and acknowledge that we may at any time modify this Privacy Notice, in whole or in part, by posting such modifications on the Websites. It is your responsibility to periodically review the Websites for such modifications, which you can determine by reviewing the Privacy Notice “Effective Date” listed below. Your continued use of the Websites and any content, programs, information, services or materials provided through the Websites will be subject, in all respects, to the Privacy Notice in force at the time of such use. CALIFORNIA’S PRIVACY LEGISLATION:
The California Consumer Privacy Act (“CCPA”) and the California Privacy Rights Act (CPRA) provide California residents who are natural persons (“California Residents”) with the additional rights described in this section (CCPA and CPRA referred to collectively as “California’s Privacy Legislation”).
For the purposes of this section, Personal Information shall include the categories of information included in the definition of “Personal Information” under California’s Privacy Legislation.
Under California’s Privacy Legislation, twice per year, California Residents have the right to know and see what Personal Information Foundation Source has collected about them over the past 12 months, including:
- The categories of Personal Information collected;
- The categories of sources from which the Personal Information has been collected;
- (Where applicable) the categories of Personal Information that we sold or shared about you;
- The categories of Personal Information that we disclosed about you for a business purpose.
- The business or commercial purpose for collecting or disclosing their Personal Information;
- The categories of third parties with whom Foundation Source has shared their Personal Information;
- (Where applicable) the categories of service providers, contractors, and/or third parties with whom we shared or sold that Personal Information; and
- The specific pieces of Personal Information Foundation Source has collected about them.
- If we sold or disclosed your Personal Information for a business purpose, two separate lists disclosing:

- Request that we disclose what Personal Information is disclosed for a business purpose, or sold or shared, and to whom.
Please note that in regard to the right of “data deletion,” there are a number of exceptions, however, that include, without limitation, when the Personal Information is retained by Foundation Source or a third party to:
- Complete transactions with the California Resident, including to provide a good or service requested by the California Resident, take actions reasonably anticipated within the context of our ongoing business relationship with the California Resident, or otherwise perform our contract with the California Resident;
- Provide the California Resident with services;
- Perform under a contract with the California Resident;
- Help to ensure the security and integrity of the Websites and/or related services, to the extent the use of the Personal Information is reasonably necessary and proportionate for those purposes;
- Debug or fix errors in its systems, website or software;
- Comply with a legal obligation;
- Use for internal purposes that are reasonably aligned with the expectations of the California Resident based on the California Resident’s relationship with Foundation Source and compatible with the context in which the California Resident provided the Personal Information.

In the twelve months preceding the date on which this Privacy Notice was last revised, we have not “sold” Personal Information; however, we have “shared” certain Personal Information for cross-context behavioral advertising purposes—specifically, by displaying advertisements to you based on your activities over time and across nonaffiliated websites or online applications. For purposes of this section, “sold” and “shared” have the definitions provided by California’s Privacy Legislation. Information regarding our sharing of Personal Information is set out below:

California Residents have the right not to be discriminated against for exercising any of their rights under California’s Privacy Legislation.
Foundation Source will respond to California Residents’ requests to see what Personal Information Foundation Source collects about them and to delete their Personal Information within 45 days of receiving the request. If Foundation Source requires more time, it will inform the requesting California Resident of the reason and extension period in writing.
Notice of Financial Incentives
In addition to the above, California’s Privacy Legislation requires that we notify you if we provide “financial incentives” – defined as a program, benefit, or other offering – related to the collection, deletion, or sale of Personal Information. From time to time, we may provide promotions or incentives to prospective and current clients of Foundation Source’s services. Additionally, individuals can sign up or provide us with their Personal Information (e.g., email address) to receive incentives related to our products and services, or participate in our promotions. As such, our incentives or promotions may be considered financial incentives provided in exchange for the collection and retention of Personal Information under California’s Privacy Legislation. We offer these incentives and promotions to enhance our relationship with you, or so that you can engage with us while receiving some of these benefits. There is no obligation to opt-in to such incentives, and consumers may opt-out at any time. The details of each program are contained in each such program offering.
The Personal Information that we receive in exchange for your participation is dependent on a number of factors—for example, whether you take advantage of any offerings, and the extent to which you do so; however, such information is roughly equivalent to the value of the product incentive or promotion offered. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
Exercising California Residents’ Privacy Rights
To exercise their rights under California’s Privacy Legislation, California Residents can submit a request by completing and submitting this form. Alternately, California Residents can contact us at . If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
We may need to request specific information from you to help us confirm your identity and complete your request. This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information related to your request to enable us to process your request more efficiently.
Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. You are entitled to request that we provide information from beyond the twelve-month period, but we will not be required to provide such information if providing such information proves impossible, would involve disproportionate effort, or is otherwise permitted by California’s Privacy Legislation. The response we provide will also explain the reasons we cannot comply with a request, if applicable.
Note that, depending on your use of the Websites, not all of the categories or examples of Personal Information that we collect, as provided above, may apply to you.
Additionally, please note we may need to retain certain information for record keeping purposes, and there may also be residual information that will remain within our databases and other records, which will not be removed from such locations. Additionally, there may be circumstances in which we are not legally required to comply with your request because of the laws in your jurisdiction or because of exemptions provided in California’s Privacy Legislation.
Online Tracking Choices.
Some web browsers incorporate a “Do Not Track” (“DNT”) or similar feature that signals to websites that a user does not want to have the user’s online activity and behavior tracked. If a website that responds to a particular DNT signal receives the DNT signal, the browser can block that website from collecting certain information about that browser’s user.
